5. Third-party rights.

The provisions of paragraphs 2 (use of the site and disclaimer of all warranties) and 4 (Indemnification) are for the benefit of Lush Ride and its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the service. Each individual or entity shall have the right to assert and enforce those provisions.

6. Term; termination.

The provisions of paragraphs 1 (copyright, licenses, idea submissions and trademarks), 2 (use of the site and disclaimer of all warranties), 3 (limitation of liability),  4 (Indemnification), 5 (third party rights) and 7 (Miscellaneous) shall survive termination of this agreement.

7. Miscellaneous.

This agreement shall all be governed and construed by the laws of the United Kingdom applicable to agreements made and to be performed in the United Kingdom. You agree that any legal action or proceeding between Lush Ride and you concerning this Agreement or the parties obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in the united kingdom. Any cause of action or claim you may have concerning the service must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. Lush Ride’s failure to insist upon or enforce strict performance of any provision of this agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this agreement. Lush Ride may assign its rights and duties under this Agreement to any party without your notice.

Any rights of Lush Ride not expressly granted herein are reserved.

Changes

We encourage you to review the privacy policy whenever you access or use our services or interact with us to stay informed about our information practices and how you can help protect your privacy. We may change the terms and conditions and privacy policy occasionally. If we do, we will let you know by revising the date at the top of the policy. If we change this policy that, in our sole discretion, is material, we will provide you with additional notice.
